cer of the Foreign Country".
It will be observed that no distinction is made
in the ordinance between those particular countries
with whom special Conventional arrangements on the
subject have been entered into by the United Kingdom
and Foreign States generally.

I am directed by the Board of Trade to acknow-
ledge the receipt of your letter of the 27ta. June
last, transmitting a copy of a communication with en-
closure from the Colonial Office, in which the ques-
tion is raised in connection with a case of desertion
from an American ship while at Hongkong whether it
primarily rests with the Consul of the United States,
as that Officer contenus, or with the Stipendiary
Magistratu, to determine whether a seaman in certain
cases is a "deserter"

to be laid before the Marquess of Salisbury, a copy
of a Memorandum by the Solicitor to this Department;
and
The Under Secretary of State,
Foreign Office.
